Montana's New Edible Rules: What Changed on July 1, 2026

Published:
October 30, 2026

If your favorite gummy feels a little lighter than it used to, you're not imagining it. On July 1, 2026, Montana cut the maximum THC in a single edible serving from 10mg to 5mg. The package limit stayed at 100mg, so a full-strength pack now holds at least 20 pieces where it used to hold 10.

The same day, a second law changed the warnings printed on the bag you carry out of the dispensary. Here's what both laws mean the next time you shop for edibles in Bozeman, Belgrade, or anywhere else in Montana.

Montana Edible Rules at a Glance

The Big Change: 5mg of THC Per Serving

House Bill 636 passed during the 2025 legislative session and was signed on May 8, 2025. Lawmakers gave the industry more than a year to prepare, and the law took effect July 1, 2026.

The bill changed one number in Montana's dispensary law. A single serving of an edible marijuana product used to be capped at 10mg of THC. It is now capped at 5mg.

In practice, that means:

  • Each piece is half as strong. A gummy, chocolate square, or other single serving sold to adult-use customers tops out at 5mg of THC.
  • Packs hold more pieces. A 100mg package went from 10 servings to 20.
  • Labels were redone. Packaging has to show the new serving size, so the milligrams per serving and the serving count on the label match what's inside.
  • Old stock is gone. The Montana Department of Revenue told dispensaries that packages made under the old 10mg limit could not be sold after July 1. Everything on the shelf today meets the new rule.

Lab results can still land up to 10% above or below the limit, so a serving labeled 5mg may test anywhere from 4.5mg to 5.5mg.

What Didn't Change

The new serving limit applies to edibles only. Montana's other adult-use potency limits are the same as before:

The basics of buying haven't changed either. You still need to be 21 or older with a valid government-issued photo ID, and out-of-state IDs are still welcome at both Juniper locations.

What it Means for Medical Cardholders

Montana law already allowed dispensaries to sell products with higher THC potency to registered medical cardholders, and House Bill 636 left that provision in place. The 5mg serving limit is the standard for adult-use sales.

Which higher-potency products a shop actually stocks is a separate question. If you hold a Montana medical card, ask your budtender what's currently available for patients.

New Warnings on Your Exit Bag

A second law, House Bill 792, also took effect on July 1, 2026. It doesn't change what you can buy. It changes what's printed on the bag you leave with and what's posted at the register.

Every exit bag in Montana now carries four state-written warnings next to the universal marijuana symbol:

  • WARNING: Consumption of marijuana may cause anxiety, agitation, paranoia, psychosis, and excessive vomiting.
  • WARNING: Consumption of marijuana by pregnant women may result in fetal injury and low birth weight.
  • WARNING: Consumption of marijuana by nursing mothers may result in infant hyperactivity and poor cognitive function.
  • WARNING: Driving while under the influence of marijuana is a crime.

The bag also carries a QR code that links to substance use resources from SAMHSA, the federal Substance Abuse and Mental Health Services Administration. Dispensaries display a consumer education poster with the same warnings and resources at each point of sale.

The Department of Revenue's rules spelling out the bag and poster details took effect August 22, 2026. If your bag has a sticker with the new wording, that's allowed: shops can label their existing bags until replacements arrive.

How to Shop for Edibles Under the New MT Rules

The math is the only thing that really changed. A few habits make the switch easy:

  1. Read the label, not the piece count. Check the milligrams per serving and the total for the package. Two packs with the same number of gummies can hold different totals.
  2. Convert your usual dose. If one 10mg gummy was your go-to, that's two pieces now. If you used to cut a 10mg gummy in half, one piece does the job with no knife required.
  3. Give it time. Edibles pass through your stomach and liver before you feel them, so they come on slower and last longer than smoking or vaping. Wait a full two hours before deciding whether you want more.
  4. Start low if you're new. One 5mg piece, or even half of one, is a sensible first try. You can always take more next time.
  5. Store them like medicine. Keep edibles in their child-resistant package, out of reach of kids and pets.

Smaller servings do have an upside. It's easier to fine-tune a dose in 5mg steps than in 10mg steps, which helps both first-timers and regulars who know exactly where they like to land.

Frequently Asked Questions

Are 10mg edibles illegal in Montana now?

A single edible serving sold to adult-use customers can't contain more than 5mg of THC. The law sets how products are portioned and labeled. It doesn't set how many pieces an adult chooses to eat.

Can I still buy a 100mg package of edibles?

Yes. The package limit is still 100mg of THC. It's now divided into 5mg servings.

Does the 5mg limit apply to tinctures or capsules?

No. Tinctures are still limited to 800mg of THC per package, and capsules to 100mg per capsule and 800mg per package.

Does the limit apply to medical marijuana patients?

State law lets dispensaries sell higher-potency products to registered cardholders. Ask your budtender what's in stock for patients.

Can visitors buy edibles in Montana?

Yes. Anyone 21 or older with a valid, unexpired government-issued photo ID can buy recreational cannabis in Montana, including visitors from other states.

Can I take edibles into Yellowstone?

No. National parks are federal land, and cannabis is illegal there under federal law no matter what Montana allows. Our guide to cannabis shops near Yellowstone covers the details.
